Congress Should Leave Alice Alone

Posted on: 2017-05-02

Overturning the Supreme Court Decision Would Allow Abstract Patents to Hurt innovation One of the most important cases to cut back on the availability of vague, abstract patents was the 2014 decision Alice v. CLS Bank. In Alice, the U.S. Supreme Court reaffirmed the long-standing law that patents could not be granted on "laws of nature, natural phenomena, and abstract ideas." The decision reinvigorated the use of 35 U.S.C. § 101 to invalidate abstract patents based on the fact that they claim unpatentable subject matter. Alice was a watershed moment. In the decades before Alice, the Court of Appeals for…

Post-TPP Special 301 Report Shows How Little Has Changed

Posted on: 2017-05-01

Last Friday the United States Trade Representative (USTR) released the 2017 edition of its Special 301 Report [PDF], which the USTR issues each year to "name and shame" other countries that the U.S. claims should be doing more to protect and enforce their copyrights, patents, trademarks, and trade secrets. Most of these demands exceed those countries' legal obligations, which makes the Special 301 Report an instrument of political rhetoric, rather than a document with any international legal status. Last year's Special 301 Report included 45 references to the Trans-Pacific Partnership, which was at the time soon expected to become the jewel…

Stupid Patents of the Month: Taxi Dispatch Tech

Posted on: 2017-04-28

With all the attention ride-sharing has been getting lately, some might think Uber and Lyft were highly inventive apps. But according to at least one company, the apps are just highly infringing. Who’s right? Probably neither. Hailo Technologies, LLC (“Hailo”) has recently sued both Uber and Lyft, alleging they infringed Hailo’s taxi dispatch patent, U.S. Patent No. 5,973,619 (“the ’619 patent”). The patent claims a method for a “computer system” that: (1) displays a list of transportation options; (2) asks the customer for a number of passengers; (3) shows destinations graphically; (4) displays the approximate fare; (5) calls a selected…

Top secret messages sent via Confide might not be so secret after all

Posted on: 2017-04-24

Nervy constituents! Prying newspapers! Always wanting to find out what politicians are up to, who they’re talking to, and what they’re saying! No wonder politicians (and their whistleblowing staff) have flocked to message-erasing app Confide. It’s like Snapchat for professionals who want to keep their discussions on the down low: it automatically erases all conversations, uses a version of the end-to-end encryption used by bigger rivals such as Signal, Telegram, WhatsApp, Facebook Messenger, and a growing list of others, and avoids its rivals’ susceptibility to having messages screenshotted by hiding them until the recipient moves a finger or cursor over…
